Council Approves Fireball Zoning

During its regular Oct. 16, 2018 meeting, the Forney City Council met and THIS IS VERY ROUGH DRAFT:


  • Public Comment - none
  • Approved as a single consent item:

    • a facade renovation at 208 and 210 S. Bois D'Arc Street.
    • a revised site plan for Windmill Farms Private School, located west of Windmill Farms Boulevard and north of Concord Drive in the City of Forney extra-territorial jurisdiction.
    • the acceptance of Public Improvements for Lake Pointe Church development.

  • Chief Sherwin said they have started the campaign for using peoples security cameras. He then showed a presentation considering establishment of a juvenile curfew during overnight hours. They would likely consider a midnight - 6am curfew. They met w/ FISD student councils, who were generally neutral on the idea, synergy students slightly favored a curfew. He said there are a lot of defenses against this, as they are taking away freedoms. It is very difficult to enforce a curfew ordinance. Citations could be issued to parents, minors. Mr. Myers asked what the process was for defense - Sherwin went through some scenarios. Ms. Penn said parents might not know kids are out, she wanted it on agenda due to all the break-ins. Mayor Wilson asked about issues at park - Chief said during summer there was, officers have been talking to kids, issued citations for speeding and word got out quickly among juveniles. Mr. Myers asked about issues other cities had - enforcement, generally contacting the parent is all needed. Ms. Penn would like this on another agenda for action.
  • the upcoming holidays and if there needs to be any adjustment to the dates for Council meetings. Mr. Carson requested input from council, they will need two meeting in Nov. They prefer to delay Jan. meetings one week, cancel Dec. 18 meeting.
  • Held Public Hearings -

    • Approved an ordinance approving the 2018 Annual Service Plan Updates, including the collection of the 2018-2019 Annual Installment for The Villages of Fox Hollow Public Improvement District No. 1 (Capital PID)
          Mr. Thatcher said approved a plan last year, council has obligation to review the plan, there are no changes to assessments levied, this will be done annually.
          Mayor Wilson reiterated there are no increases in taxes. Mr. Thatcher said they are not taxes, but levies, but are collected the same way for Maint PID, but will have to send out bills for this PID.
          There was no public input.
    • Approved an ordinance levying special assessments against the assessable property within the Fox Hollow Public Improvement District No. 1 (Maintenance PID) and approving the final update to the Service and Assessment Plan, pursuant to the provisions of Chapter 372 of the Texas Local Government Code. The PID contains approximately 813.605 acres of land generally located southeast of FM 548 between FM 1641 and FM 741 (Fox Hollow)
          Mr. Thatcher said this covers maintenance needs, been levied since 2004, it is annual, no changes to rates are recommended. Mr. Myers asked if the rate would be reviewed annualy - yes.
          There was no public input.
    • Approved 6-1 (Mayor Wilson no) an Ordinance to rezone property from AG Agricultural District to PD Planned Development District with a base zoning district of LI Light Industrial District. The property consists of approximately 102.037 acres of land located at the southwest corner of S. Gateway Boulevard and U.S. Highway 80.
          Mr. Morgan briefed the council - the property will have 1.2 mil building, only access from 212 are for fire, requires CUP for above 36'???, cement fiber is allowed. at P&Z 8 spoke against, applicant responded to concerns, P&Z approved.
          Mr. Finley said this is for Goodyear, 160 employees, 3-4 trucks / hr, They are 920 ft from gateway, there will never be trucks stacked on gateway. N. side is 480 ft from hwy 80, 500 ft from 212, they are adding landscaping around building. He showed a truck route map showing all traffic using hwy 80. All products stored inside, no hazmat or manufacturing. He showed some artist conceptions from roads and aerial, and photos of existing buildings in Ft Worth and Mississippi. Mr. Moon asked if Goodyear was located elsewhere - this is a new facility. He asked about violence around such areas - Mr. Finley said might be theft, as with any business. Mr. Moon asked if jobs are all new, or moving other employees - Mr. Finley didn't know. They will own the building, lease it to Goodyear.
          Ms. Penn asked who puts items on P&Z agenda, she heard the agenda said were hazardous materials; Mr. Morgan said it was not. She asked about the barbed-wire fencing - Mr. Finley said it will, why they are adding landscaping. She asked Hunt reps if anything would be located in front of it - Mr. Finley said they would own it, green-space. They have detention requirements, that's an ideal place for detention pond. Mayor Wilson said they are trying to meet standards for green area for that much hard surface. Ms. Penn asked about number of trees - that will come at later stages.

  • Vision 2025 -- Goals/Initiatives Mr. Carson asked if council had questions - Mr. Moon asked if they could send out an email about progress. Sat Nov. 17 workshop.
  • Approved a request by Shane Spillers of Enos to close Main Street on Saturday, December 8, 2018, for a special event. Mr. Carson he thought it was a great idea.
  • Approved a request for a variance from the City of Forney Subdivision Ordinance, Section 3.5, and the acceptance of Public Improvements for Grayhawk Subdivision Phase 3.
  • Discussed a preliminary plat for Travis Ranch South, a residential subdivision located west of F.M. 460 and north of U.S. Highway 80 in the City of Forney extra-territorial jurisdiction.
  • Approved establishing a CIP project for the enhancement of downtown crosswalks.

  • Held a 45-minute executive session re:
    • Growth Management Plan/Annexation

  • Approved as one consent item:

    • a Resolution setting the date, time and place for public hearings on a proposed involuntary annexation of a 29.224 acre tract of land owned by Pacific and Pinson, situated in the J. Lopez Survey, Abstract No. 286, Kaufman County, Texas, KCAD Property ID No. 9187.
    • a Resolution setting the date, time and place for public hearings on a proposed involuntary annexation of a 48.717 acre tract of land owned by Helen M. Whaley, situated in the A. Hyer Survey, Abstract No. 203, Kaufman County, Texas, KCAD Property ID No. 7810.
    • a Resolution setting the date, time and place for public hearings on a proposed involuntary annexation of a 51.431 acre tract of land owned by Whaley Investments, Ltd., situated in the A. Hyer Survey, Abstract No. 203, Kaufman County, Texas, KCAD Property ID No. 7865.

  • Approved 6-1 (Wilson nay) a preliminary plat for Travis Ranch South, a residential subdivision located west of F.M. 460 and north of U.S. Highway 80 in the City of Forney extra-territorial jurisdiction.
