P&Z considers Brookville Ph. 2, Oak Park

During its regular Oct. 08, 2020 meeting, the Forney Planning & Zoning Commission met to consider Brookville Estates, Oak Creek, city buildings.(watch official video)

  • Held Public Hearings -
    • Approved 5-1 (Chambers nay) an Ordinance amending the Brookville Estates Planned Development (Ordinances 1066 and 1137) by amending the development standards and concept plan for Phase 2.
          Mr. Morgan said this is N. of FM 740, W. of Ranch Rd, to the North is where new FISD schools are.  A zoning request was made in Aug, was denied and now has been revised.  Now min. lot area of 7,400 sq ft with average of 8,500 with at least 75% being over 8,000.  This is an increase of a few hundred over last request.  Current standard would require over 9,400 sq ft as phase 1 were smaller than average.  Minimum home size has been increased from 1500 to 1800 sq ft, 30% 2000 sq ft.  Fees instead of parkland.  A trail along the Atmos easement is being negotiated.  One response was received to public notices, in opposition due to decrease in lot size.
          Mr. Clint Richardson, w/ developer, spoke about increasing lot and home sizes.  They removed parkland, as city no longer desires pocket parks.  Some changes were due to school development, allowing students easy access.  They could address Mr. Wilkin's concerns by moving open spaces into back yards, but believe this is a better plan, with the pedestrian connection to school.
          Chair. Shimkus asked if builder would put in trail - yes, build it with start of construction, $80k cost.  Chair. Shimkus asked about tracking park fees to be used at specific parks - Mr. Morgan said they can do that.  Mr. Bingham asked about lot widths and setbacks - 62 ft unchanged, front setback 20 or 25 with garage, increasing back yards to 15 ft.
          Ms. Holler asked about HOA lots - one at Old Glory Lane is odd.  Mr. Richardson said they bought this phase during downturn, this is part open space and detention, they made it larger than needed.  It is lower than other lots.  Ms. Holler asked about current min lot size - 7200, avg 8200, but ph 1 were smaller.  Ms. Holler said if Heritage Hill Park would get funds, will there be a crosswalk? Probably along gas easement, expect city would stripe the crosswalks, 740 will be widened at some point.  Ms. Holler asked if would be a screening wall there - no.
          Mr. Craig Curry, owner, who stated they are not original owners - property went into foreclosure.  They aren't increasing density, up-sized lots, worked w/ FISD about drainage easements, the trail took much negotiating, is about 90k expense, putting in masonry along 740 instead of wood fence.
          Ms. Holler asked if need to stipulate walking trails - Mr. Thatcher said not making conditional approval, don't want to do that for zoning, but future plans will be examined for the trail since developer agreed to it.
          Mr. Bingham asked what happens if Atmos turns down request - developer said they could do the trail in HOA areas, along 740 to cul-de-sac.
    • Approved an Ordinance rezoning 38.7 acres from Planned Development No. 1031 to a single-family residential Planned Development. The property is located south of S. F.M. 548 and Sycamore Trail.
          Ms. Holler recused herself and left the chamber.
          Mr. Morgan said this is across from Trails of Chestnut Meadows.  This would have separate standards from existing PD.  Due to constraints and easements , can't build the 191 lots allowed.  Original concept plan showed 103 lots on this site.  Proposed is 45 ft wide lots with 117 lots.  Current standards are 8,000 sq ft lots, 60 ft wide, min. homes 1500 - 2000 sq ft.  Propose SF6, min lot 4,950 sq ft, min. home 1,800, lot width 45 ft, side yard 5ft, front setback 20 ft, 25 ft w/ garage.  A dog park will be built and dedicated instead of park land, cost equivalent to what the fees would be.  As can no longer regulate building materials w/ zoning, a developer agreement would, that would be approved by council.  Received one response to public notices in opposition, concerned about traffic.  A TIA was done when would 103 lot plus remaining 191, should be sufficient for this 117 lots.
          Mr. Bingham asked how many developments approved w/ 45 ft lots - Mr. Morgan said maybe 2, Brooklyn Village is one.  Mr. Chambers asked about traffic control- Mr. Zook said nothing proposed for that intersection.  Chair. Shimkus asked if currently they could build 191 lots - Mr. Grooms said yes, and they spoke w/ TxDOT who has no objection to their driveways.  Dog park would be at 548 and Walnut (at he corner of property).  Would be for the entire community, have a parking pad, benches, shade.  Developer will build it, then dedicate to city.  Mr. Grooms said this is first true garden-home development.  Mr. Bingham asked if residents would have access to pool - no, will have their own HOA and playground area.  Mr. Bingham asked, being so close to highway, will dog park be fenced - yes, will have two areas for large and small dogs.  Mr. Bingham asked if additional requirements for patio homes, such as restricting rentals.  Mr. Grooms said they are being sold as owner-occupied.  Mr. Brown asked when dog park would be constructed - in beginning.  This is a one-phase build-out.  Mr. Brown said lots are smaller, but home sizes are same as original - yes, 1800 is minimum, and those are starter homes.  Mr. Grooms said Mr. Thatcher has the proposed document.  Mr. Bingham asked about green spaces for easement - Mr. Grooms said negotiating with utilities to allow fencing, but it has gas, electric and force-flow sewer easements.
          Mr. Chambers asked if would keep existing trees - Mr. Grooms city has 3-1 replacement plan for hardwoods, most of trees are in flood plain and would not be touched.
          There was no public input.
    • Approved a Conditional Use Permit for a major auto repair facility to operate at 12549 Reeder Road.
          Mr. Dixon said this is a 1,216 sq ft metal panel building with legal non-conforming shared parking.  Use is dent repair.  Reviewing with applicant, fire marshal and building official: will not be filing, sanding, grinding or painting done on location.  Nothing dangerous being done.  No outside storage would be needed, council could remove CUP if that were violated.  No response to public notices.
          Mr. Jeff Long speaking for owner, said this is one car in and out business, no tools outside, no painting.  Chair. Shimkus asked about hours - standards 8-5.  Mr. Bingham asked what turnaround is - plan allows up to 5 cards inside, all work is by appointment, should be no overlap.

  • Approved a final plat for Ryhn Addition, located north of Don T. Cates Drive and east of North F.M. 548.
        Mr. Dixon said this is to establish boundaries for commercial development, 1 acre, approved in 2019, plat still shows access to 548.
  • Approved a site plan for the Public Works Storage, located south of the intersection of Kaufman Street and Mesquite Street.
        Mr. Dixon said this is vacant 3.2 acres in GR, municipal facilities allowed by right.  includes 3,600 sq ft metal wall / PBR building, outside storage of vehicles and equipment require screening.  Will have 6' chain-link fence.  On property, building is farthest from residential units.
        Ms. Holler asked if anything was likely to be built near this, Mr. Morgan said met with adjacent property owner who might build a house there, they made him aware.  Mr. Zook said east is flood plain, nearest a building could be done there is past property line.  Chair. Shimkus asked about runoff - Mr. Zook said this is just storage, no maintenance will be done.  Mr. Bingham asked if only used for storage - yes, nothing hazardous.  Mr. Chambers asked about covered parking - Mr. Zook said 8 bays inside, they left room for possible future use, but might just be parking.
  • Approved a revised site plan for the Community Development and Public Works Offices, located at 101 E. Aimee Street.
        Mr. Dixon: will establish site design, existing building shares the block w/ fire station 1, zoned in SF 6 , municipal allowed by right.  This will connect the 490 sq ft area as an enclosed lobby, visitors could enter public works or community dev.
